Contractor Blamed for Death of Worker

The Occupational Safety and Health Administration has found that a simple guardrail or harness would have prevented the death of 24-year-old Jonathan Fundalinski. Fundalinski's death is being blamed on his employer, David Burke Construction LLC because the site lacked basic protections around a 30-foot hole in the floor. However, a lawyer for the construction company says Fundalinski should have known better and he should be blamed. "He was trained to put [protection gear] on," said lawyer Robert G. Walsh. "Why he didn't do it that day is unfathomable."

David Burke Construction plans to challenge OSHA's penalties, which include five safety violations and a $49,000 fine. Fundalinski's family was not able to be reached for comment.
